An estrus notifying method executed by a computer that determines estrus based on a step count measurement result from a step count measurement unit attached to each livestock animal among a plurality of livestock animals, the estrus notifying method comprising:
collecting the step count measurement result of each livestock animal at certain intervals;
detecting a change time slot in which a change rate of the step count measurement result relative to an immediately preceding time slot is greater than or equal to a predetermined value among a predetermined proportion or more of the plurality of livestock animals;
determining for each livestock animal and based on the step count measurement results excluding the step count measurement result corresponding to the change time slot, whether the livestock animal is in estrus; and
outputting identification information of the livestock animal determined as being in the estrus.
基本上是一個中規中矩的claim,技術手段交代的也算清楚。比較值得注意的是這幾篇專利的claim與說明書中完全沒有出現Internet of Things (IoT)、Internet of Everything (IoE)或是Big Data等字眼,甚至其IPC分類也是被分在A01(畜牧業)以及A61(獸醫學),而非物聯網專利常見的G06(計算;推算;計數)、H04(電氣通信技術)等,這表示在對解決方案這種類型的專利進行檢索時要特別注意檢索條件,避免因為預設檢索框架而遺漏了先前技術。
以美國專利申請號14/173,105這件專利為例,申請人Emc Corporation (易安信公司) 是美國的一家跨國資訊科技企業,這件專利發明名稱為Collecting data in internet of things,以下是其專利申請範圍:

receiving status data from at least one sensor node;
extracting content data from the status data received from the at least one sensor node;
aggregating the content data; and

剛剛提到針對特定技術或裝置的物聯網專利在侵權問題上比較簡單,但在權利金(royalty)的計算上可能會遇到與上一段的相反狀況,就是專利只claim物聯網solution的部分元件或是技術,但希望以整個物聯網solution作為計算基礎,這時就有更多問題要探討了,例如Entire Market Value Rule或其他擴張之態樣。
此外,物聯網專利還有其他議題像是標準必要專利(SEPs)以及授權交易平台,這裡僅簡單介紹幾個較新的資訊。關於SEPs,台灣智慧局(TIPO)與國家實驗研究院科技政策研究與資訊中心共同合作,針對4G LTE的SEPs開發建置「通訊產業關鍵專利資訊平台」,其經由技術專家篩選後提供近7,500篇專利資訊以及涉訟相關資料,在2016年4月已上線。授權交易平台則是有國外的Avanci,以其固定費率的收費方式來提供專利授權許可服務,而這概念其實之前也有出現過,就是已經收攤的IPXI (Introduction to Intellectual Property Exchange International),其遭遇到許多現實的問題,未來Avanci能否簡化物聯網的授權程序還值得觀察。
