Whereas protection is conferred by way of registration upon the right holder for those design features of a product, in whole or in part, which are shown visibly in an application and made available to the public by way of publication or consultation of the relevant file.
Protection shall be conferred for those features of the appearance of a registered EU design which are shown visibly in the application for registration.

關於可見性要件,歐盟現行規範之所以呈現若有似無的曖昧狀態,其實是源自立法協商過程中,針對不同零備件保護利益交換下的意外結果。除提案採用「表面可見之外觀」等措辭外,歐洲議會同時也於1996年CDD草稿增列複合產品之可見性要件(又稱「引擎蓋下排除條款(under the hood)」),意在事先排除離合器、消聲器、引擎本體等機動車輛內部元件之保護,顯然是針對汽車零備件而來。儘管如此,在當時氛圍下,汽車製造商對此等規定並無太多反彈,僅是強烈主張外部零備件保護。
